Terms of Service

These Terms of Service ("Terms") govern your use of Past Clients by Pareto (the "Service"), operated by Pareto ("we," "our," or "us") at pastclients.bypareto.com. By connecting your Google account and using the Service, you agree to these Terms. If you do not agree, do not use the Service.

What the Service Does

The Service reads real estate transaction emails in the Gmail account you connect and extracts a list of your past transactions, including property addresses, closing dates, whether you represented the buyer or seller, and client names, email addresses and phone numbers. Results are shown in your dashboard and can be exported as a CSV file.

We access your Gmail using read-only permission. We never send, modify, label or delete your email.

Your Account

• You must be at least 18 years old and authorized to access the Gmail account you connect.
• You are responsible for activity that occurs under your account, and for keeping access to it secure.
• You may disconnect the Service at any time from your Google account permissions.

Accuracy of Extracted Data

Extraction is performed automatically, including by AI language models, from unstructured email content. It is not guaranteed to be complete or correct. Transactions may be missed, duplicated, or attributed to the wrong party, and individual fields — names, email addresses, phone numbers, closing dates, cities and states — may be inaccurate.

You are responsible for reviewing extracted data before relying on it or contacting anyone. Do not treat the output as a verified record. The Service is a research aid, not a system of record, and must not be used as the sole basis for any legal, financial, tax or compliance purpose.

Your Responsibilities for Client Information

The Service surfaces personal information about your past clients and other third parties from your own correspondence. You remain responsible for that information and for how you use it.

• You confirm you have a lawful basis to hold and use your clients' contact information.
• You are solely responsible for complying with laws that apply to contacting them, including the Telephone Consumer Protection Act (TCPA) and applicable rules on calls and text messages, CAN-SPAM and other email marketing rules, do-not-call registries, and state privacy laws.
• You are responsible for honoring any request from a client to access, correct or delete their information.
• You may not use the Service to compile information about people with whom you have no legitimate business relationship.

Acceptable Use

You agree not to:

• Connect a Gmail account you are not authorized to access.
• Use the Service to build marketing lists of people who are not your own past clients or contacts.
• Attempt to access another user's account or data, or probe or disrupt the Service or its infrastructure.
• Resell, sublicense or redistribute the Service, or use it to provide a competing service.
• Use the Service in violation of any applicable law.

Third-Party Services

The Service depends on third parties including Google (account sign-in and Gmail access), Anthropic (AI extraction), Railway (hosting and database) and the United States Census Bureau geocoder (address verification). Their handling of data is described in our Privacy Policy. We are not responsible for the availability or acts of those third parties.

Ownership

The Service, including its software, design and content, remains our property. Your email content and the transaction data extracted from it remain yours. You grant us only the permission needed to operate the Service for you.

Pricing and Refunds

Your first scan and a preview of your list are free. Opening the full list is a one-time payment of $99 per account, charged through Stripe at the price shown at checkout. It includes CSV export and a monthly check of your mailbox for new closings, which you can switch off in Settings at any time.

If the list is not right for you, email hey@bypareto.com within 7 days of payment and we will refund it in full. A refunded payment closes the full list again. Prices may change; a change never affects a payment already made.

Availability, Changes and Termination

• The Service is provided on an ongoing but not guaranteed basis. We may modify, suspend or discontinue it, in whole or in part, at any time.
• You may stop using the Service at any time and request deletion of your data.
• We may suspend or terminate access if you breach these Terms or if required to protect the Service or other users.
• Export any data you wish to keep before terminating; we are not obliged to retain it afterwards.

Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that extracted data will be accurate or complete.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or exemplary damages, or for lost profits, lost business or lost data, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred US dollars ($100).

Indemnification

You agree to indemnify and hold us harmless from any claim, demand, loss or expense, including reasonable legal fees, arising from your use of the Service, your handling or use of client information obtained through it, or your breach of these Terms or of any applicable law.

Changes to These Terms

We may update these Terms from time to time. If we make material changes we will update the date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict of laws rules. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Tennessee, and you consent to their jurisdiction.
